TERMS AND CONDITIONS

  1. Agreement to Terms

By accessing or using the BeyondCrayons website (beyondcrayons.ca) and submitting forms or information through our website (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”).

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and BeyondCrayons (“Agency,” “we,” “us,” or “our”), a licensed home daycare placement and coordination agency operating in Ontario, Canada.

If you do not agree to these Terms, you must not access or use our website or submit any information to us.

  1. Purpose of the Service

BeyondCrayons is a childcare placement and coordination agency licensed in Ontario. We operate a website where:

  • Families submit applications seeking connections with home daycare providers
  • Home daycare providers submit applications to partner with our agency
  • General users can submit inquiries through our Contact Form

We are NOT the childcare provider. We facilitate introductions and connections between families and independent licensed home daycare providers. Providers are independent contractors responsible for their own operations, licensing compliance, and childcare services.

Information on our website is informational only and does not constitute professional, medical, legal, or childcare advice.

  1. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new “Last Updated” date.

Your continued use of our website after any modifications indicates your acceptance of the updated Terms.

  1. Eligibility and Accuracy of Information

To use our Services, you agree to:

  • Provide accurate, current, and complete information in any forms you submit
  • Promptly update any information if it changes
  • Notify us immediately of any errors or inaccuracies
  • Truthfully represent any information related to yourself, your child, or your business
  • Comply with all applicable Ontario and Canadian laws

If you submit information on behalf of a child or family member, you represent that you have the legal authority to do so.

Information you provide through our forms (Parent Application, Provider Application, Contact Form) is used solely for:

  • Reviewing and processing your application
  • Matching families with licensed home daycare providers
  • Facilitating communication between matched parties
  • Managing our waitlist and services
  • Responding to inquiries
  • Complying with Ontario licensing requirements

We do not use your information for marketing, resale, or any other purpose without your explicit consent.

  1. Intellectual Property

All content on the BeyondCrayons website, including text, graphics, logos, images, and overall design, is owned by or licensed to BeyondCrayons and is protected by copyright and trademark laws.

You may not copy, reproduce, distribute, or use our branding, logos, or content without prior written permission.

  1. Acceptable Use Policy

You agree not to use our website to:

  • Engage in any illegal, fraudulent, or deceptive activity
  • Transmit spam, unsolicited messages, or malware
  • Harass, threaten, or abuse other users or BeyondCrayons staff

9.1 No Guarantee of Placement

BeyondCrayons facilitates connections between families and home daycare providers. We do not guarantee any placement, match, or successful arrangement. All matching is subject to availability and mutual agreement of both parties.

9.2 Your Responsibility to Verify

Families must conduct independent due diligence before selecting a home daycare provider:

  • Conduct personal interviews with providers
  • Check references provided by the provider
  • Visit the provider’s home and observe their operations
  • Verify the provider’s license status with the Ontario Ministry of Education at ca/daycare
  • Review the provider’s policies, fees, and procedures
  • Check the provider’s background and reputation

9.3 Providers Are Independent Contractors

Home daycare providers are independent contractors, not employees of BeyondCrayons. They are solely responsible for:

  • Maintaining valid Ontario licensing
  • Compliance with all childcare regulations
  • Quality and safety of childcare services
  • Fees and service terms
  • Disputes with families
  • Their own conduct and operations

9.4 No Liability for Provider Conduct

BeyondCrayons is not responsible for:

  • The quality or safety of childcare provided
  • Any actions, omissions, or misconduct by providers
  • Any harm, injury, or damage caused by providers
  • Compliance with licensing by providers
  • Disputes between families and providers
  • Provider fees, cancellations, or refund disputes
  1. Disclaimer – “As Is” Basis

THE BEYONDCRAYONS WEBSITE AND ALL SERVICES ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The website will be uninterrupted, secure, or error-free
  • Information on the website is accurate or complete
  • Any placements will result in satisfactory arrangements
  • Any defects will be corrected
  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEYONDCRAYONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR:

The total liability of BeyondCrayons for any claim shall not exceed ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

  1. Indemnification

You agree to indemnify, defend, and hold harmless BeyondCrayons, its officers, directors, employees, and agents from any claims, liabilities, damages, or costs arising from:

  • Your use of our website or Services
  • Your violation of these Terms
  • Your failure to conduct due diligence with providers
  • Any disputes between you and home daycare providers
  • Any information you provide to us
  1. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes shall be resolved exclusively in the courts located in Ontario, Canada.

  1. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeyondCrayons and supersede all prior agreements and understandings.
